Veterans are pursuing compensation from 3M Company for several types of injuries associated with defective 3M Combat Arms earplugs, including hearing loss and damage, tinnitus, problems with balance, and other inner ear- and hearing-related injuries from exposure to loud noises during service.
More than a hundred veterans have taken action and filed lawsuits against 3M Company for their dual-ended, yellow and black Combat Arms earplugs. These veterans used the 3M earplugs between 2003 and 2015 and now suffer hearing loss and other impairments.
Service Members Trusted 3M Combat Arms Earplugs to Protect Their Hearing
Loud, explosive sounds are a part of everyday life for many members of the U.S. Armed Forces. From planes to artillery to improvised explosives, loud noises are everywhere. Hearing damage can occur quickly if they do not have the hearing protection necessary to prevent it. At the same time, though, they need to be able to hear orders and information given by their commanding officer and others in their squadron.
This is where 3M Combat Arms earplugs come in. These dual-sided earplugs feature a yellow end that promised to allow soldiers to hear conversation yet protect their ears from loud noises. However, the pending lawsuits call 3M Company’s bluff. The lawsuits claim the earplugs did not seal well enough to keep loud sounds out and did not come with instructions to ensure proper use.
Lawsuits Against 3M Company Allege Knowledge of Defective Earplugs
The lawsuits filed against 3M Company allege they knew about the problems with their Combat Arms earplugs as early as 2000. There are even allegations they falsified paperwork and may have used this paperwork to help them score the government contract to supply troops with these earplugs. Whether there is evidence to support this accusation remains to be seen.
What we know for sure is that many members of the military who served while these earplugs were in use now suffer from hearing damage and related conditions. The 3M Combat Arms earplugs lawsuit lawyers handling these cases will attempt to link these factors, building a strong enough case to force 3M Company to offer a fair settlement or to convince the courts to award compensation to the affected veterans.
These Cases May Qualify for Multidistrict Litigation
As of April 2019, there is no mass tort action against 3M Company related to their Combat Arms earplugs. It is still very early in the legal process, though. There is still time for other veterans to take action, and this could become a mass tort.
If the courts combine all these lawsuits related to Combat Arms earplugs into multidistrict litigation (MDL) or another type of mass tort, this could reduce the cost and improve the efficacy of taking hundreds or thousands of similar cases to trial at once. The cases may qualify for MDL, which combines them for pretrial actions and discovery then proceeds to several bellwether trials before sending the remaining cases back to their original jurisdictions for trial or settlement.
