Our client, while visiting her husband at a nursing facility, suffered a devastating fall as she was leaving and walking toward her car. She fell off an improperly designed curb, resulting in a broken hip. At first glance, this appeared to be a simple accident, where a person falls off of a curb; but our investigation uncovered critical details that changed the course of the case.
We discovered that the curb in question violated multiple building codes and American with Disabilities Act (ADA) standards, including issues with curb height, the lack of ramp access to handicapped parking spots and visibility standards. These violations directly contributed to our client’s fall and injury.
