If you live in Pennsylvania and are applying for Social Security Disability (SSD) benefits, you may be wondering how long the process takes and what each step involves. At Berger and Green, we understand how frustrating and stressful this process can be especially when you are dealing with a serious medical condition. Here is a look at the SSD application timeline from start to finish so you know what to expect.
The first step is submitting your application to the Social Security Administration (SSA). You can do this online by phone or in person at your local Social Security office in Pennsylvania. You will need to provide information about your medical history, work, background daily activities and more.
Once your application is submitted it is sent to the Bureau of Disability Determination (BDD), which is Pennsylvania’s agency that reviews SSD claims. A claims examiner and a medical consultant will evaluate your records and may request additional information or schedule a consultative exam. This step usually takes three to six months.
If your initial claim is denied you have 60 days to file for reconsideration. This step involves a new claims examiner who will take another look at your case including any new medical evidence you provide.
Unfortunately, most reconsideration requests in Pennsylvania are also denied. Still, this is an important part of the process that must be completed before you can request a hearing. It usually takes three to five months to get a decision at this stage.
If your claim is denied again, you can request a hearing before an Administrative Law Judge (ALJ). This is often the most important step in the process. You will have the opportunity to speak directly to the judge and explain how your condition affects your ability to work.
In Pennsylvania it can take 12 to 18 months to get a hearing date depending on your local hearing office. During this time, it is crucial to continue medical treatment and collect evidence to support your claim.
Having legal representation at this stage is strongly recommended. At Berger and Green, we help you prepare for the hearing and present your case clearly and effectively.
If the judge denies your claim, you can request a review from the Social Security Appeals Council. They may uphold the judge’s decision, reverse it or send the case back for another hearing. This stage can take six months to a year.
If all other appeals are denied you may file a lawsuit in federal court. This is a more complex step that requires experienced legal guidance. The timeline for federal cases varies.
The SSD process in Pennsylvania can me lengthy, but you do not have to go through it alone. At Berger and Green, we have helped thousands of clients across Pennsylvania get the benefits they deserve. Contact us today for a free consultation. We are here to stand by you from start to finish.
