Appealing Your Social Security Denial
If you have been denied Social Security Disability Insurance Benefits (DIB) or Supplemental Security Income (SSI) you have a limited time to appeal the decision. When you receive your denial, you have 60 days (with a 5 day grace period to receive the letter) to file an appeal. If you do not file an appeal within 60 days your claim will be closed and if you continue to be unable to work you will have to file a new claim.

The next step in the appeals process in Pennsylvania and a few other states is a hearing in front of an Administrative Law Judge. In most states the next step is a Request for Reconsideration. You can choose to have an attorney represent you at either the reconsideration or the hearing.

The Appeals Council may decide to uphold the Administrative Law Judge's decision or to review the decision at the Appeals Council and pay your claim, or to send the case back to an Administrative Law Judge for another hearing. If you are denied at the Appeals Council you can file a lawsuit in a Federal District Court.
