Mass Tort: What You Need To Know

You may have heard the term “mass tort” before, but you may not know what it means.

Tort is a “wrongful action” that causes an injury, and is generically referred to as a personal injury claim

A mass tort is different from a personal injury claim. A mass tort involves numerous plaintiffs against one or a few defendants in a state or federal court.

The lawsuits are a result of the at-fault party causing injuries to numerous individuals through the same or similar act of harm or product.

Some common mass tort claims are often injuries caused by a drug, medical device or defective product such as car airbags.

Mass tort lawsuits can make it much easier for plaintiffs to succeed against big corporations such as product and medication manufacturers. By bringing all the individual claims at once, it reduces the cost of litigation for the individual plaintiffs.

Even though individuals in a mass tort are part of a large group, each member is still treated as an individual.  This means that each person must prove certain facts, including how each person was injured by the at-fault party and what damages they sustained.

Contacting an experienced mass tort attorney will help your claim.

If you were injured due to a defective product you may be entitled to economic and non-economic damages.

This includes:

  • Medical treatment
  • Lost wages
  • Out-of-pocket expenses
  • Property damages
  • Other related expenses
  • Pain and suffering

Recovering compensation after an injury from a defective product

It is a manufacturer’s responsibility to make sure their products are safe for consumers.  If someone is injured due to a defective product, a product liability claim may exist.  A claim may be pursued to pay for damages caused by the defective product such as medical bills, missed time from work and pain and suffering.
