When you’re living with a disability that prevents you from working, the last thing you want to deal with is the stress of defending your claim for benefits with the Social Security Administration (SSA). The application and appeals processes can be confusing and discouraging, especially without legal support. Thankfully, you don’t have to handle your claim alone.
A Fairmont Social Security Disability lawyer from Berger and Green can take the weight off your shoulders, guiding you through the process and fighting for the benefits you deserve. Our firm has over four decades of experience in Social Security Disability (SSD) claims, and we want to add your claim to our long list of successful case outcomes. To learn more about your eligibility for SSD benefits, contact us today. We offer free initial consultations.
You can handle your application for SSD benefits alone, but we recommend having the support of a Social Security disability lawyer. Nearly 80% of initial applications receive denials from the SSA due to various paperwork issues, lack of medical evidence, and other problems. Even if you try your best, you may still face a frustrating denial, and the process for appealing a decision you disagree with can be even longer and more complicated, especially without legal representation.
We recognize these difficulties, which is why our Fairmont Social Security Disability benefits attorneys are here to help you throughout the entire claims process. We can bring many benefits to your case, including:
We’ll make the SSD claims process as simple as possible so you can focus on your well-being. That’s exactly what we did for our former client Troy, who said this about his experience with Berger and Green:
We also want to help you get what you deserve: the SSD benefits you need to get your life back on track. Let Berger and Green fight for you.
While the SSA Blue Book lists specific conditions that are commonly approved and the requirements to receive benefits, nearly any physical or mental health condition may qualify you for SSD benefits if it prevents you from working for at least a year or is expected to cause your death.
At Berger and Green, we have successfully helped thousands of disabled individuals obtain SSD benefits, including:
These former clients of Berger and Green provide just a few examples of the varying health conditions and disabilities that may qualify for SSD benefits. These people all turned to us when they didn’t know where else to go, and our SSD attorneys were able to get them the vital benefits they needed to support themselves.
We want to help you get the benefits you deserve, too. To learn about your eligibility and get started on the application or appeals process with a Fairmont Social Security Disability benefits lawyer, contact Berger and Green today.
The Social Security offers two types of benefits that you may be eligible for, SSDI and SSI:
SSDI provides benefits for disabled people who previously worked and paid Social Security taxes. In most situations, you must have at least 20 work credits (about five years of previous work) to qualify. However, the number of credits you need may vary depending on your age and other factors.
SSDI typically requires a five-month waiting period before applicants start receiving benefits. If you are on SSDI for at least two years, you will likely qualify for Medicare coverage to assist with your medical bills, according to the SSA.
To qualify for SSI, you must have little or no income or assets. There is no waiting period for benefits and no work history requirement for SSI.
In addition to monthly payments, SSI claimants also generally qualify for Medicaid coverage and access to the Supplemental Nutrition Assistance Program (SNAP), according to the SSA.
We recommend starting your application as soon as possible. We also recommend hiring us from the start, if possible, to ensure your application has the best chance of success on the first try. This can help you avoid unnecessary delays due to a claim denial.
However, if you have already filed for benefits and received a denial, it’s not too late to give us a call. Our Fairmont Social Security Disability appeals lawyers have been through the appeals process countless times and can represent you through one or more of the following stages:
