Essure Implant Complications
Bayer created and marketed the Essure Permanent Birth Control System as a simple, noninvasive method of permanent birth control. Doctors inserted the tiny Essure coils into the woman’s fallopian tubes and scar tissue formed to seal them closed. While this product is relatively effective for preventing pregnancy, complications are common. These include:
- Severe pain and bleeding
- Migration of the device
- Organ perforation
- Birth defects in children born despite the implants
Many women who received the Essure implants suffered severe enough symptoms to miss work, require medication, or even need hospitalization. Some needed surgery to remove the coils or a hysterectomy to stop the debilitating pain and other symptoms.
According to the U.S. Food and Drug Administration (FDA), there were almost 27,000 reports about Essure complications between its introduction in 2002 and December 31, 2017. Most commonly, these complications included:
- Abdominal pain and cramping
- Heavy bleeding and other menstrual irregularities
- Weight changes
There were also numerous reports about problems with the device. This includes:
- Almost 4,500 reports of allergies or other issues with incompatibility
- Nearly 3,000 reports of device migration
- 1,350+ cases of dislodged or dislocated devices
- More than 1,000 reports of broken devices
- Approximately 950 reports of the “device operating differently than expected”
- Over 300 reports that the device was difficult to remove during revision surgery
In April of 2018, the FDA restricted the use of Essure in the United States, limiting it only to use by doctors who agreed to follow strict protocols to inform their patients of the potential dangers. Bayer has since announced it will stop distribution of Essure in the U.S. at the end of 2018.

Recoverable Damages in an Essure Coils Lawsuit
There has been some question about whether Bayer had liability for the damages caused by the Essure coils because of the way the device gained FDA approval. Typically, the route they took would protect the company from liability. However, currently the courts are allowing women to take legal action and hold the device manufacturer accountable for the damages they suffered.
The courts are currently hearing each case individually, deciding each one on its own merits. As additional women file claims, there may be a move to consolidate these cases into multi-district litigation. This would allow the cases to complete pretrial motions and the discovery process as a group, continue onto bellwether trials, then return to their original courts for a final verdict.
